The Role and Impact of Islamic Law in Transitioning Arab Spring Countries

The Law Library of Congress and the Library’s African and Middle Eastern Division will host a panel discussion on the role and impact of Islamic law in the developing constitutions and laws of transitioning countries in the Middle East/North Africa region. The panel, led by moderator Mary-Jane Deeb, Chief of the African and Middle Eastern Division, will discuss the role of Shari’a law in the recent and ongoing constitutional drafting processes of Egypt, Tunisia and Libya. The discussion will also concentrate on the broader impact of Islamic law on the legal systems of Arab Spring states, looking particularly at personal status issues. Other points of discussion will include the compatibility of Shari’a law and human rights, and some of the challenges facing women and minorities in transitioning Arab Spring countries. The distinguished panel will include Nathan J. Brown, Professor of Political Science and International Affairs at the Elliot School of International Affairs at the George Washington University; Lama Abu-Odeh, Professor of Law at Georgetown University Law Center; and Issam Saliba, Senior Foreign Legal Specialist at the Law Library of Congress.

This is a conference on Joel Trachtman’s new book, The Future of International Law: Global Government, published by Cambridge University Press this year. Many of the most significant challenges we face now and will face in the future do not respect national borders and defy solution through state law alone. International law will need to step up and address these challenges. The conference addresses the global challenges that public international law will have to deal with in the coming years. It also extends the idea of the future of international law to the problems that private international law and transnational commercial law contend with on a global scale. Coverage is partial and selective, with the aim of promoting discussion.

"Whaling in the Antarctic'' before the International Court of Justice

In 2010 Australia commenced proceedings against Japan in the International Court of Justice with respect to Japan’s conduct of its Joint Aquatic Resource Permit Application (JARPAII) whaling program in the Southern Ocean. The case will commence its oral phase on June 26, 2013, with three weeks of hearings before the Court. These proceedings come at a pivotal time in the debate over the conduct of “scientific whaling” under Article 8 of the International Convention for the Regulation of Whaling and the decision of the International Court of Justice will have profound implications for how these issues are considered in the future. Please join the Australia National University (ANU) College of Law and ASIL’S International Environmental Law Interest Group for this conference that will review the background of the Whaling in the Antarctic case, the Australian application before the International Court of Justice, the proceedings to date, and the possible implications of the case for the International Whaling Commission. Consideration will also be given to the anticipated legal argument that will be made before the court, New Zealand’s 2012 Declaration of Intervention, and the February 2013 order deciding that the New Zealand intervention was permissible. The American Society of International Law and the American University Washington College of Law's Academy on Human Rights and Humanitarian Law are pleased to present a three-part continuing legal education (CLE) series to provide a forum for the better understanding and discussion of human rights and humanitarian law theory.   In the last two decades international criminal courts such as the International Criminal Tribunal for the Former Yugoslavia and the International Tribunal for Rwanda have issued judgments characterizing gender-based crimes as war crimes, crimes against humanity and genocide, depending on the context in which the crimes had been perpetrated. On the other hand, as of today, the International Criminal Court delivered the first judgment in the Case of Thomas Lubanga Dyilo in 2012, but did not consider the alleged perpetration of gender-based crimes by the defendant because the Office of the Prosecutor failed to incorporate those crimes among the charges brought against Lubanga Dyilo. Later on, the ICC accepted the inclusion of victims of sexual violence within the scope of the reparations to be awarded in this case. Furthermore, the ICC is currently considering gender-based crimes in the Katanga Case, the decision of which is forthcoming. The speakers in this panel are all experienced judges of international tribunals who participated in the decision of cases where gender-based crimes were involved. They will assess the successes and failures of these international courts to provide redress to the victims of sexual violence.

Since 1980, U.S. courts have reviewed a broad range of international human rights claims in suits filed under the Alien Tort Statute (ATS). In Kiobel v. Royal Dutch Petroleum, decided in April 2013, the U.S. Supreme Court sharply cut back on ATS suits. A panel of leading scholars, practitioners and former government officials will assess the future of human rights litigation after Kiobel. Arms Trade Treaty: Domestic and international implications

The American Society of International Law will host U.S. Department of State Assistant Secretary for International Security and Nonproliferation Thomas Countryman and other distinguished panelists for an educational event discussing domestic and international implications of the Arms Trade Treaty. On April 2, 2013 the United Nations General Assembly passed the 28-article Arms Trade Treaty (ATT), aiming to establish the highest possible common international standards for regulating conventional arms trade. The Treaty is currently open for signature at the United Nations Headquarters. While it is unknown if and/or when the treaty will enter into force and if and/or when the United States will sign it, the treaty does impose genuine legal obligations on its parties regarding the proliferation of weapons not covered by other specialized treaties and has the potential to contribute significantly to international security.

Ever since the publication of the BRIC [ Brazil, Russia, India , China ] report by Goldman Sachs in 2001, the debate about the role of emerging countries vs. the developed countries in shaping global business has gathered momentum. A revised version of the same report entitled “BRICs and Beyond” by the same authors, with upward revision of certain growth projections, has added further fuel to the debate so much so that by now, most countries have accepted that the world economy is in transition. In other words, the countries as above joined by others such as South Korea, Mexico and to some extent the major Arab countries and Iran and Indonesia will exert a much greater influence in world affairs aided by their increasing economic power. The developed countries, led obviously by the major economies of USA, Japan, Germany, Britain , France and others [ the so-called G-7/8 group of nations ] have accepted that their dominance in shaping world opinion will be shelved as the growth gradient of the emerging economies becomes increasingly steeper. Nowhere has this been more reflected than in the G-20 [Group of 20 countries – developed and emerging] meet last year [2008] in calling for fiscal stimulus to induce growth to beat the recessionary forces.

Organised by the Banking Law Symposium Views are emerging that banks are simply too big and should be broken up so that taxpayers are not again put at risk. A former Chairman and CEO of Citibank said that “It wasn’t that one or two institutions did stupid things. It was, we all did, and the whole system came down”. As well, the former Chairman of Merrill Lynch noted that he was one of the people who led the charge to get rid of Glass-Steagall and he now regrets having done that. Banks have increased in size and complexity and become global institutions challenging the reach of national regulators. What have we learned from the great financial crisis? What steps are policy makers taking to avoid similar events in the future? Has the risk culture of banking changed so dramatically? What is the future of financial regulation?

Patricia A McCoy is the Connecticut Mutual Professor of Law at the University of Connecticut School of Law and the Director of the law school’s Insurance Law Center. She recently returned to academe from the newly formed Consumer Financial Protection Bureau in Washington, DC, where she established the Mortgage Markets section in 2011 and oversaw all of the Bureau’s mortgage policy initiatives. Professor McCoy received her JD from the University of California at Berkeley. At law school, she was Editor-in-Chief of the Industrial Relations Law Journal. Following graduation, she clerked for the late Hon. Robert S Vance on the US Court of Appeals for the Eleventh Circuit. Before entering academe, Professor McCoy was a partner at the law firm of Mayer, Brown in Washington, DC. Later, from 2002 through 2004, she served on the Consumer Advisory Council of the Federal Reserve Board of Governors. She spent the 2002-2003 school year as a Visiting Scholar at the MIT Economics Department. Professor McCoy’s latest book, The Subprime Virus, was published by Oxford University Press in 2011 and written with Kathleen C Engel. This event is accredited for 1 CPD Point.

The general theme of this year's roundtable event will be financial stability and regulatory reform with special reference to the regulation of insurance markets at domestic, European and international level. The roundtable event aims to: Open up and facilitate an on-going dialogue between regulators, practitioners and the academic community on ‘what is good financial regulation post-crisis’ and ‘the kind of principles that we would like financial markets to be governed by’ with special reference to the regulation of the insurance sector. Examine in depth the limitations of systemic risk regulation and other factors that may undermine the effectiveness of macroprudential supervision and regulation. Reflect on the role (if any) of insurance intermediaries in maintaining the stability of the financial system. Set up an agenda for future research.

"Interpretation in International Law''

The relevance of interpretation to the academic study and professional practice of international law is inescapable. Yet interpretation in international law has not traditionally been examined as a distinct field. Given that international law is constituted, in practical terms, by acts of interpretation, there is a need for greater methodological awareness of interpretive theory and practice in international law. Proposed panels include: interpretation and legal doctrine; interpretation and the sources of international law; interpretation and the interpreters; interpretation and the international legal order; interpretation and cultural contingency; and interpretation and indeterminacy. This workshop is hosted by the Arbitration and Mediation Center of the World Intellectual Property Organization. The purpose of this Workshop is to provide intensive basic training of a practical nature for party representatives in arbitration and for arbitrators. The training, conducted by experienced international arbitrators, will focus on the main principles of international commercial arbitration law and practice, with particular reference to the practical case application of the WIPO Arbitration and WIPO Expedited Arbitration Rules in intellectual property and technology disputes. The arbitration rules of other arbitration institutions are also referred to for purposes of comparison. CLE/CPD credits on request.

The dynamics of international trade have taken on an added significance in the light of the challenges created by the recent global financial crisis. Entire sectors and even nations have begun to reassess their trading relationships and the more enlightened are eager to gain an insight into the theories and processes that have helped certain economies to weather the storm. The emerging giants of Brazil, China and India are demanding greater attention and ensuring that practitioners and academics alike invest more time and resources in understanding where their economies are at and how they will shape future of international trade. Since the Doha Development Round (Doha Development Agenda - DDA) began in late 2001 the issue of international trade has gained greater prominence. This academic conference is intended to contribute to the emerging theoretical understanding and empirical base and to further advance the understanding and practice of business especially international trade & management. We welcome empirical and theoretical papers which advance our knowledge of these important areas. This conference will be the platform for dissemination of knowledge, provide a learned reference in the field and facilitate communication between academic, research experts, business leaders and practitioners. The following list is indicative of the types of contributions which may be appropriate. However, it is not intended to be exhaustive and rather is illustrative.

The theme of the conference – Asia & International Law in the 21st Century : New Horizons- focuses on the great diversity around Asia’s leading powers which are no longer `emerging’ but have emerged. While countries in the Asian region may regard certain issues as of particular concern to them, those issues are generally also of great moment in other regions and/or at a global level. This conference will seek to share perspectives on emergent dimensions of international law from around the Asian region, broadly defined, and from beyond.

The world of business is undergoing a time of considerable stress, change and in some sectors unprecedented growth. Much of the conventional wisdom concerning business education and theory is being challenged and thus it is all the more important to endeavour to elucidate what is taking place. Economic certainties look increasingly vulnerable and existing formulas appear jaded and in some cases moribund. Where once academics were fixated with global brands and multi-nationals increasingly the role of SMEs is coming to the fore. Governments from Armenia to Somaliland are keen to find ways to stimulate business and thus create local employment Regrettably the global economic crisis is increasingly used as an excuse for poor performance at all levels thus limiting the search for routes out of it. It should not be seen as a destroyer but as a purifier, ensuring the survival and prosperity of the fittest. The business environment has changed and will be changing more than ever in years to come - some traditionally powerful markets have weakened while others have grown, cultural and geographical distances between people are shrinking, innovation in all aspects (technology, markets, finance, etc.) has become paramount for sustainable competitive advantage. The challenge of economic development is one faced by all nations and there is an extraordinary array of initiatives that are being put into place to act as ‘economic pump primers’. Whereas once developed markets would have only been interested in how other developed economies are stimulating economic development, increasingly there is interest in how developing economies are proving fertile nurseries for imaginative and often successful initiatives. An added dimension is the role that new technologies can play. This conference seeks to explore a wealth of issues related Business and Economic Development, contributions should therefore be of interest to scholars, practitioners and researchers in management in both developed and developing countries targeting a worldwide readership.
